Below Average Dave FAQCopyright & ParodiesWho do I contact to advertise on badave.com? Well, my email correspondant is Matthias (matthias@badave.com), You should contact him and he will contact the appropriate department If I submit a parody here on badave.com, do I retain copyright?Yes, I do not claim copyright of any parody I do not personally record Is it legal to make parodies without the artist's permission?Yes, Weird Al gets permission as a matter of professional curteousy. Most of us don't have the means to get said approval. Legally, parodies are a form of criticism therefore protected by the first ammendment. There are a number of things that differentiates wether or not a parody is legal. The main thing is just that you change the majority of the song for the purpose of comedy or to criticize something. That is protected by our first ammendment and has been continously upheld by the courts. Can I link to a parody that I didn't write? No. Although we do contact artists who someone suggests a link to and see if perhaps they are interested in being listed. Do you guys host mp3 or mpg files for parodies?Kinda. We do, but we don't host a lot because right now the financial aspect of it just isn't there. It would cost us a lot to host mpg's, so we don't at this time. We do host mp3s, but limited to a small amount per artist do to bandwidth and financial reality. Perhaps in the future we'll do it on a commercial level, right now it's more of a request only basis for regulars on the site. Why Below Average Dave?Probably my most common question. No I do not have a major self esteem issue, but the name reflects the recording quality of my older recordings, and the name just stuck. I don't think It would be as fun if I wasn't Below Average Dave, I mean Average Dave just doesn't have the same ring to it. |
